Moya de Luca-Leonard solicitor

This is my story of dealing with solicitor named Moya de Luca-Leonard. It is a part of my larger story of the Legal fees and my (personal injury claim). De Luca-Leonard represented from 2020-06 till 2022-11

She promised a lot, but did only one thing (submitted application for further medical assessment and got my PTSD recognized). Yet, charged as if she has done everything and more.

This is a more pressing issue as I have not done anything about it yet. Simply had no time. However, the last reply I got from OLSC is that they may take 6 months before they look at my complaints due to current workload. There were some Moya actions that been hidden in my mind that are resurfacing only now, after the tribunal:

She told me that the court case against the driver for damage to the bicycle and CTP insurance claim are linked. Later on, I found that this is not true. This caused me an enormous amount of mental health damage.
She ignored my plea to include information about factually incorrect assessment provided by a psychologist hired by QBE solicitors, and the same incorrect statements by QBE solicitor. This made a huge impact on my claim making it almost impossible to claim loss of income.
She resigned from my claim without completing it, yet with exaggerated legal costs.

After one year of de Luca-Leonard resigning, I have realized that I want to write a complaint to OLSC about it. However, I have concerns about evidence I have as some most hurtful things were said on the phone. Complaint to OLSC

I felt betrayed by Moya de Luca-Leonard and wrote a complaint about her to OLSC. I find it difficult dealing with trauma related stuff. Due to my low capacity to function and time constraints I submitted information about her misconduct in parts. The response was very unexpected.

History

2023-10-29: I submitted a complaint Complaint to OLSC about solicitor Moya de Luca-Leonard. OLSC case number CAS014655.
2023-11-27: It is very difficult to write complaint properly and remember all important bits, while having severely reduced cognitive abilities. Brining all stressful memories while writing complaint might be too much for a brain and to protect yourself it might block some part of memory. This is the case with me now. Some memories come back, and I am writing an update for my complaint. It does not change the content of complaint, just provide additional evidence: 2023-11-20 Moya not disputing incorrect information provided by Ceballos.
2024-08-26: OLSC dismissed my complaint based on reasons that were not a part of the complaint.
2024-09-24: I submitted request to review of OLSC decision File:2024-09-24 Request to review decision to dismiss complaints CAS014655 CAS014772.pdf as my complaint was dismissed without proper process.
current: I was planing to send one more updated of complaint about Ms de Luca-Leonard when I can. The dismissal of my complaint put me in situation where I am not sure should I be doing this. After long consideration, despite very negative response, I decided to complete writing complaint about Moya de Luca-Leonard. I hope that my that the decision to dismiss my complaint without looking at it will be I am preparing additional information about misconduct of Ms de Luca-Leonard.

This is a fifth part of the complaint about Moya de Luca-Leonard (one original complaint and four addendum).

I already supplied information that Moya de Luca-Leonard did not dispute lies stated by QBE solicitor Timothy Ceballos and directly and by report written by psychologist Vanitha Moodley. Ceballos and Moodley intentionally provided incorrect statements in attempt to deceive and mislead Personal Injury Commission (PIC). I provided detailed de Luca-Leonard with detailed information about these lies. She promised to take appropriate actions, but did not do anything. This addendum provides information on communications with de Luca-Leonard leading up to PIC panel assessment and lack of her actions despite my requests.

Moya de Luca-Leonard made sure that correct information does not reach PIC and as a result made almost impossible for me to get compensation for loss of past and future income.

I am sorry that I have to provide information in small parts, but I can not cope with it otherwise.

Communications

2022-03-21: Moya de Luca-Leonard wrote to me that documents being prepared and there is nothing for me to do. During previous zoom meeting and other communications she indicated that lies provided by Ceballos will be addressed in lawyers submissions. Now submissions were being prepared. After this no emails for a while.
2022-06-07: de Luca-Leonard wrote that PIC scheduled panel teleconference on 2022-07-08. See "2022-06-07 email from Moya - informing on teleconference with PIC panel on 2022-07-08.pdf", "2022-06-07 lr client email 45.pdf", "2022-06-07 PIC portal messages.pdf".
2022-06-07: Barrister Michelle Campbell informed that she has not prepared submissions and advised to leave panel to decide if examination is required. As there was no more information about it, I had nothing to go on with, but to agree.
2022-06-09: de Luca-Leonard sent me draft statements. As before she excluded everything I told about lies from Ceballos and Moodley. Unfortunately, I believed de Luca-Leonard explanation and promise, that it can and will be included only her submissions. 2022-06-27: I was concerned that I have not seen Ceballos and Moodley lies being exposed. I have not seen de Luca-Leonard and Campbell submissions yet, they also did not include my attempts to expose it in statements. So, I reminded level of lies by Moodley that there were incorrect statements almost in every paragraph. Some of incorrect statmens went to absurd levels as stating that I was depressed before the injury and my girlfriend Juste had to make meal for me before going to work, while living in a different continent! I insisted of me taking part in a meeting as I had previously bad experience from assessment by PIC assessor Matthew Jones, who provided lots of incorrect statements. Unfortunately, I kept this information out of my and my wife's statements as drafter by Moya and Campbell. 2022-06-29: Di, in a name of de Luca-Leonard, sent me a list of documents they are going to send next day. I such short time I had no time to check it. See "2022-06-29 email from Moya - Private - list of document they are going to send to PIC.pdf", "2022-06-29 Index of Documents DRAFT.pdf".
2022-06-30: I replied to de Luca-Leonard email. Previously on the phone conversations with de Luca-Leonard I was asking to participate in upcoming meeting and to expose lies from opposing team. I was told that I can not participate and that she aware of information I provided and will present it during the meeting. To be sure I was planing to write a letter to panel. I struggle to present information during meetings, failing every time, and email was better option. However, I was told that I can not do that. Di also confirmed this. I was told that only information provided previous assessor Dr Wayne Mason can be provided. I trusted them. However, now when checking the give information I can see that

2022-07-21: de Luca-Leonard sent me an email with schedule information for PIC panel assessment conference. The misleading incorrect and deceiving information provided by QBE representatives was never exposed by de Luca-Leonard. My complaint

Moya de Luca-Leonard did not follow my instructions to expose lies provided by QBE representatives solicitor Timothy Ceballos and psychologist Vanitha Moodley. I provided information about my requests and de Luca-Leonard promises in previous parts of the complaint and in this one: my email to de Luca-Leonard on 2022-06-27. She had multiple occasions to do so and a lot of time up till PIC panel assessment on 2022-09-30. However, she has not done so. This damaged my claim a lot, making almost impossible to get compensation for loss of income.

I would have provided this information to PIC if de Luca-Leonard told me that is not going to do so. This would saved me from my claim being dragged for about 2 years, lots pain and suffering, and would allowed my to get compensation for loss of income.
