Problem with LawPartners (solicitor Gillian Pottos, barrister Kenneth Pryde)
I am seeking help dealing with misrepresentation and grossly exaggerated fees by law firm LawPartners. Now there is $173,327.71 stuck in the trust fund with interest going to LawSociety and a complaint at OLSC that I am sure will be dismissed.
Between 2018 and 2020 Law Partners (solicitor Gillian Pottos, barrister Kenneth Pryde) firm represented me against QBE due to a personal injury, but their management was precarious and a deeply retraumatized experience. Along the 2 year process it could be evidenced by lack of transparency, purposeless meetings, refusal to collect and use important medical evidence about the consequences of the accident. After the personal injury I was left with PTSD, this was the main purpose for issuing the claim against QBE but working with Law Partners not only failed to help, it caused further harm and left me in a worse state than before.
Between the reasons of mishandling my case we can evidentiate: the omission of PTSD as the central consequence of my injury, the constant inflation of fees despite the 30% cap they promise, the involvement of different characters(barrister, medical advisor, etc.) that were not only unhelpful but give the wrong information about my case and the pressure to accept a low settlement without proper independent assessments. They ignored critical reports from treating specialists that have accompanied me through the process, relied on biased assessments favorable to the insurer, and presented incomplete or misleading evidence that weakened my case. These actions demonstrate not only negligence but also misconduct that put their financial interests above my wellbeing and legal rights.
As a result I was left with exaggerated bills for minimal and poor work. Furthermore, I was explicitly pressured to cooperate with their strategy under the threat that, if I refused, they would begin increasing their fees. Unfortunately, this is exactly what happened: when I raised concerns or requested independent assessments, they disregarded my requests and inflated the costs even further, using my lack of compliance as an excuse. Because of this I sought advice from other lawyers, who confirmed that my claim was in fact worth significantly more than what Law Partners had pushed me to accept. They explained that with proper handling the compensation could have been at least $200,000 higher. Their conduct significantly reduced the compensation I could have obtained and erased the progress I had made in recovering from PTSD.
At the start they estimated all costs including disbursements at $70,000. The cost would be about half if no need to go to court and even lower if settlement reached before independent assessment (similar to tribunal).
As of today, Law Partners continues to demand exaggerated fees. They issued invoices for $173,327.71. Before parting they stated that if I accepted their proposed settlement they would reduce it to $110,000 plus disbursements. They exaggerated it to pressure me to accept an unfavorable outcome under threat of financial penalty. Furthermore, while the funds from my claim remain frozen in a trust account, the accrued interest is being directed to the Law Society rather than benefiting me as the rightful claimant. According to my calculations, this has already caused a financial loss of approximately $13,099 over 638 days (at an average of $20.53 per day), and the loss continues to grow daily. This situation not only deepens the financial harm I have suffered but also highlights the unfair practices being imposed on me. After my claim was closed and I started to look for a way to justice dealing with them, LawPartners agreed to reduce their bill to $40,000. However, after so much suffering caused by them it does not feel right. They did not do their job, caused a lot of pain and now I still have to pay them as if they did everything right.
